Welcome to Sip & Soul Retreats. These Terms & Conditions (“Terms”) apply to all visitors, users, and participants engaging with Sip & Soul Retreats through our website, events, retreats, or community-based activities. By accessing our website or registering for any Sip & Soul experience, you agree to be bound by these Terms.
Please read these Terms carefully, as they outline important rights, responsibilities, and expectations for participation. Any significant changes to these terms will be communicated via email or the booking portal.
1. Age Requirement
All participants must be 21 years of age or older to access, register for, or attend any Sip & Soul Retreats event, retreat, or activity. By booking, you confirm that you meet this requirement.
2. Booking & Payment
- A $500 deposit is required at the time of booking.
- Full payment is typically due 60 days before the retreat start date, unless otherwise specified.
- Failure to complete payment may result in cancellation of your reservation without refund.
3. Cancellation & Refunds
All cancellation and refund terms are governed by our Cancellation & Refund Policy, which forms part of these Terms. By booking, you acknowledge and agree to that policy.
4. Transfers to Another Participant
Unless otherwise stated: – Registrations may be transferred to another person at least 30 days before the retreat start date. – The new participant must be 21+ and agree to all Sip & Soul Retreats’ policies. – A transfer fee may apply.
Sip & Soul Retreats reserves the right to approve or deny transfer requests.
5. Code of Conduct
Sip & Soul Retreats is committed to fostering a supportive, respectful, inclusive, and safe environment for all participants, staff, and partners. By registering for any retreat or community activity, participants agree to uphold the following standards:
5.1 Expected Behavior
Participants agree to:
- Treat all guests, staff, facilitators, and service partners with courtesy and respect.
- Communicate with kindness, patience, and consideration.
- Follow retreat guidelines, schedules, instructions, and all safety protocols.
- Consume alcohol responsibly, recognizing personal limits and respecting others around you.
5.2 Prohibited Behavior
The following behaviors are strictly prohibited:
- Offensive, abusive, or aggressive language or actions.
- Hate speech, discriminatory comments, slurs, or harassment based on race, gender, sexual orientation, religion, age, nationality, or any protected characteristic.
- Political soapbox rants, campaigning, or disruptive political discourse that affects group harmony or comfort.
- Behavior that endangers oneself, other participants, staff, or retreat partners.
- Excessive intoxication, disorderly conduct, or disruptive behavior tied to alcohol consumption.
- Violation of local laws, retreat venue rules, or activity guidelines.
5.3 Conduct that significantly disrupts is defined as:
- For purposes of this Agreement, “significantly disrupts” refers to any behavior, action, circumstance, or unforeseen event that materially interferes with the safe, enjoyable, or functional operation of the retreat. This includes situations that require Sip & Soul Retreats to modify, suspend, or cancel retreat activities, or that compromise the safety, comfort, or well-being of any participant.
- Examples include, but are not limited to: aggressive or unsafe behavior; harassment; intoxication that poses a safety risk; violation of retreat or venue policies; medical or health emergencies; communicable illness; damage to property; failure to follow safety instructions; or unforeseen circumstances such as severe weather, natural disasters, transportation failures, or venue closures.
5.4 Consequences of Violations
Violation of the Code of Conduct may result in immediate removal from the retreat or event, at the discretion of Sip & Soul Retreats staff or leadership.
If removal is required:
- No refund or credit of any kind will be issued.
- The participant must leave the retreat premises immediately.
- Sip & Soul Retreats will assist in identifying available alternate lodging.
- The participant is fully responsible for all expenses associated with:
- Alternate lodging
- Transportation
- Meals
- Any additional costs resulting from their removal
5.5 Participant Responsibility
By booking, each participant acknowledges they are accountable for their actions and agrees to respect the well-being, comfort, and experience of the entire group.
6. Health, Wellness & Personal Responsibility
Participants are responsible for managing their own health and well-being. By attending a retreat or event, you acknowledge that:
- You are participating voluntarily in all activities.
- Some wellness experiences (e.g., hiking, yoga, tastings) may involve physical activity.
- You are responsible for assessing your ability to participate safely.
Sip & Soul Retreats is not responsible for any injuries, illnesses, or medical conditions that occur during or after participation.
Staff will assist in contacting emergency services if needed.
We strongly recommend consulting your physician before beginning any new wellness activity.
7. Alcohol Consumption & Alcohol-Free Options
As our retreats often include wine experiences:
- Participants must drink responsibly.
- Sip & Soul Retreats is not liable for injuries, damages, or issues resulting from alcohol consumption.
- Staff may decline to serve alcohol at their discretion if safety is a concern.
There will be non-alcoholic options at each retreat. Options may include coffee, tea, juice, mocktails, etc. Mocktails may not be non-alcoholic wine.
8. Property Damage
Participants are financially responsible for any intentional or negligent damage they cause to retreat facilities, lodging, equipment, or property belonging to Sip & Soul Retreats or its partners.
9. Travel Requirements & Responsibilities
Participants are responsible for:
- Booking their own airfare and transportation
- Meeting passport, visa, or travel documentation requirements
- Arriving at the retreat on time
Sip & Soul Retreats is not responsible for travel delays, cancellations, or additional travel-related expenses.
10. Travel Insurance
Sip & Soul Retreats highly recommends purchasing comprehensive travel insurance that covers:
- Trip cancellation or interruption
- Medical emergencies
- Lost or delayed baggage
- Natural disasters or unexpected disruptions
Travel insurance is the participant’s responsibility. We recommend travel insurance through www.travelnomads.com
11. Changes to Retreat Itineraries
While we aim to deliver every retreat as advertised, Sip & Soul Retreats reserves the right to:
- Modify schedules, activities, or accommodations
- Substitute facilitators, venues, or wellness practitioners
- Adjust itineraries due to weather, safety concerns, or unforeseen circumstances.
These changes do not entitle participants to a refund or credit.
12. Photography & Media Release
These changes do not entitle participants to a refund or credit.
Participants may opt out by notifying us in writing before the retreat begins. Otherwise, you grant Sip & Soul Retreats permission to use images featuring you in marketing materials, social media, and website content.
13. Limitation of Liability
To the fullest extent permitted by applicable U.S. and international law:
13.1 General Liability
- Participation in Sip & Soul Retreats (U.S.-based or international) is voluntary and at your own risk.
- Sip & Soul Retreats, its owners, employees, contractors, and partners are not liable for injury, illness, death, property loss, or damages resulting from:
- Physical activities, including but not limited to yoga, hiking, fitness sessions, spa treatments, wine tastings, or excursions.
- Environmental conditions such as weather, terrain, wildlife, or natural disasters.
- Alcohol consumption or related incidents.
- Personal medical conditions or failure to disclose relevant health information.
- Accidents, theft, or loss that occur at lodging, during transportation, or at retreat venues.
These conduct standards apply throughout the duration of the retreat, including during scheduled activities, shared accommodations, transportation arranged by Sip & Soul, and informal or unscheduled interactions that may impact group safety, comfort, or the retreat environment.
13.2 Third-Party Providers
Sip & Soul Retreats collaborates with third-party hotels, transportation companies, excursion operators, and wellness practitioners.
These entities operate independently.
- Sip & Soul Retreats is not responsible for the actions or omissions of third-party providers.
- Any claims related to services provided by third parties must be made directly to those providers.
13.3 International Travel Liability
For retreats held outside the United States:
- Participants are responsible for confirming passport validity, visa requirements, entry/exit regulations, vaccinations, insurance, and local laws.
- Sip & Soul Retreats is not liable for disruptions related to immigration issues, passport/visa denial, border closures, political unrest, epidemics, or changes in government policy.
- Participants acknowledge that international travel may involve additional risks, including transportation differences, cultural variations, limited medical access, or unpredictable conditions.
13.4 Room Assignments, Shared Lodging, and ADA Compliance
Room assignments are based on registration order, availability, and the comfort of the full group. While room requests are welcomed, specific room or suite placements cannot be guaranteed. The Luxury Bunkhouse is utilized only as needed depending on final group size; a request for this suite does not guarantee assignment. Solo travelers may be placed in shared accommodations, including the built-in, cubby-style bunks, which are designed for privacy and comfort. Total retreat capacity is limited to 12 guests. Guests requiring ADA accommodations must notify us during registration so that appropriate arrangements can be secured.
13.5 Force Majeure
Sip & Soul Retreats is not liable for delays, changes, or cancellations caused by events beyond our reasonable control, including:
- Natural disasters
- Acts of terrorism
- Political instability
- Labor strikes
- Public health emergencies
- Government mandates or restrictions
- Airline or transportation disruptions.
In such cases, refunds or credits will be issued in accordance with our Cancellation & Refund Policy.
13.6 Limitation of Claims
Any claim against Sip & Soul Retreats must be submitted in writing within 60 days of the end of the retreat or event. Claims filed after this period are waived.
13.7 Maximum Liability
If Sip & Soul Retreats is found liable despite the above limitations, the maximum liability will not exceed the total amount paid by the participant for the retreat.
14. Website Use & Intellectual Property
All content on the Sip & Soul Retreats website—including text, images, branding, and media—is the property of Sip & Soul Retreats. The copyright for specific images is retained by the photographer.
Users may not copy, distribute, or use content for commercial purposes without the written permission of the copyright holder.
15. Personal Use & Media Sharing
We love it when guests share the magic of their Sip & Soul Retreat experience. You are welcome—and warmly encouraged—to post your personal retreat photos and videos on social media for non-commercial use. When sharing, we appreciate attribution to Sip & Soul Retreats to help others discover our community.
Please note that group photos and general retreat images may be taken during events and activities. By participating in a retreat, you acknowledge that photography and videography may occur and grant Sip & Soul Retreats permission to use these images for marketing and promotional purposes, unless you inform us in writing prior to the retreat. A simple photo-release waiver will be included in your registration materials for full transparency.
Guests agree not to use Sip & Soul Retreats’ content—including logos, branded materials, or professional photography—for commercial purposes without written consent.
16. Privacy Policy
Your use of the website and participation in retreats are also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data.
17. Governing Law & Jurisdiction
17.1 U.S.-Based Retreats & Domestic Bookings
For retreats taking place within the United States or for bookings made by U.S. residents:
- These Terms are governed by the laws of the state of Colorado.
- Any disputes will be resolved exclusively in the state of Colorado.
17.2 International Retreats
For retreats held outside the United States:
- Local regulations, venue rules, and host country requirements may also apply.
- Participants agree to comply with all laws, customs, and safety standards of the destination country.
- Legal claims related to international retreats will still be governed by the state law where Sip & Soul Retreats is registered, unless otherwise required by local law.
17.3 Conflict of Laws
If any law conflicts with these Terms, Sip & Soul Retreats’ Terms will still apply to the fullest extent permitted.
18. Dispute Resolution
In the event of any dispute, claim, or controversy arising out of or relating to your participation in Sip & Soul Retreats, use of our website, or interpretation of these Terms, the parties agree to resolve the matter as follows:
- Informal Resolution First: You agree to attempt to resolve any dispute informally by contacting Sip & Soul Retreats at hello@sipandsoulretreats.com. We will make reasonable efforts to resolve the issue within 30 days.
Any dispute, claim, or legal action arising out of or relating to your participation in Sip & Soul Retreats, use of our website, or interpretation of these Terms shall be governed by the laws of the State of Colorado. All such legal proceedings must be filed exclusively in the County Court or the District Court of Summit County, Colorado. By engaging with Sip & Soul Retreats, you consent to the jurisdiction and venue of these courts and waive any objection to such jurisdiction on the grounds of forum non conveniens or otherwise.
- Waiver of Class Actions: All claims must be brought on an individual basis. You agree not to participate in any class action or class-wide arbitration.
- Governing Law: This clause is governed by the laws of the State of Colorado, without regard to conflict of law principles.
- Exceptions: Either party may seek injunctive or equitable relief in a court of competent jurisdiction for matters involving intellectual property or unauthorized use of confidential information.
19. Attorney’s Fees
In the event of any dispute, claim, or breach arising out of or relating to this Agreement, the prevailing party shall be entitled to recover its reasonable attorneys’ fees, legal costs, and expenses incurred in enforcing its rights under this Agreement. For purposes of this provision, “prevailing party” includes any party who obtains relief through settlement, mediation, arbitration, or judgment.
20. Updates to These Terms
Sip & Soul Retreats may update these Terms at any time. Changes will be posted on our website with an updated “Last Updated” date.
Continued use of the website or participation in events constitutes acceptance of the updated Terms.
